Terms of use

The rules for using this website, and what it is and is not.

Build note: unreviewed draft

Everything below is a generic starting-point draft, written so counsel has something to mark up rather than a blank page. It has not been reviewed by an attorney. The medical disclaimer and the limitation of liability in particular carry real weight for a clinical practice publishing health content, and a template cannot account for a practice operating in both New York and New Jersey.

Facts the practice or its attorney still has to supply are marked TO CONFIRM in the text. Search src/pages/terms-of-use.astro for that phrase to find every one of them. There is no effective date on purpose — dated terms read as settled, and these are not.

The page stays noindex until that review is done, so draft terms cannot be indexed or relied on. Remove noindex in src/pages/terms-of-use.astro at sign-off, and not before.

Nothing here is medical advice

Everything on this website is general health information, published to help you understand a problem and decide what to do about it. It is not a diagnosis, not a treatment plan, and not a substitute for being examined by a licensed clinician who knows your history. Reading it does not make you our patient.

1. Accepting these terms

This website is operated by RedCore Physical Therapy + Wellness (“RedCore”, “we”, “us”). By using it you accept these terms. If you do not accept them, please do not use the site.

These terms govern the website only. Treatment you receive at one of our clinics is governed by the consent and financial paperwork you sign there, and by the law that applies to clinical care — not by this page.

TO CONFIRM — the registered legal entity name and the state it is organised in, so these terms name the correct contracting party.

2. Medical disclaimer

The condition pages, blog posts, exercise descriptions and workshop material on this site are general education. They describe how a problem tends to behave and what physical therapy tends to involve. They cannot account for your history, your examination findings, your imaging, your medications or anything else that makes your case yours.

Do not use this site to diagnose yourself. Do not delay seeing a clinician, and do not stop or change treatment a clinician has prescribed, because of something you read here. If a symptom is new, severe, or getting worse, get it looked at.

Where a page names a clinician as having reviewed it, that review confirms the general information is accurate. It is not advice to you, and it does not put that clinician in a treating relationship with you.

3. Using this site does not make you our patient

Reading these pages, submitting the appointment request form, signing up to the newsletter or emailing us does not create a therapist-patient relationship or any other professional relationship between you and RedCore or any of its clinicians.

That relationship begins when you are seen at one of our clinics and the paperwork for your care is completed. Until then, nobody here is treating you, and no duty of care arising from treatment has begun.

4. Emergencies

If you are having a medical emergency, call 911 or go to your nearest emergency department. Do not use this website, the appointment request form or email to report an urgent problem. None of them is monitored continuously, and a message sent through them may not be read for some time.

5. Appointment requests

The form on our appointment request page is a request, not a booking. Nothing is scheduled until somebody from the clinic has spoken to you and confirmed a time. If you have not heard back from us, please call (718) 509-9888 rather than assume an appointment exists.

Please do not put medical details in that form. It is not a secure channel for health information, and we will ask about your symptoms when we call or in our secure intake form afterwards.

Being able to send a request does not mean we can take you on. Whether we can treat you depends on clinical suitability and on your insurance, both of which we check before your first visit.

6. Acceptable use

You may use this site for your own personal, non-commercial purposes. You may not:

  • Attempt to gain unauthorised access to the site, its systems, or anything connected to them.
  • Interfere with the site, overload it, or disrupt anyone else’s use of it.
  • Scrape, harvest or bulk-collect content or contact details from it.
  • Submit false information, or submit somebody else’s personal details without their permission.
  • Upload anything malicious, or use the site to harass, threaten or defame anyone.
  • Misrepresent yourself as connected to RedCore, or use our name or marks in a way that suggests we endorse you.

We may restrict or block access to anyone who does any of these things.

7. Intellectual property

The text, photographs, illustrations, layout, logo and wordmark on this site are owned by RedCore or licensed to us. The RedCore name and logo are our marks.

You are welcome to read the site, print a page for your own use, and share a link to it. You may not republish our content, sell it, or use it in your own materials or marketing without our written permission.

TO CONFIRM — the photography licence terms and any photographer credit lines required, plus whether any of the marks are registered and should be identified as such.

We link to other organisations — professional and certification bodies, insurers, mapping and review services, and social media. Those sites are not ours. We do not control them, we are not responsible for their content, their accuracy or their availability, and a link is not an endorsement of everything on the far side of it.

Once you leave this site, that site’s own terms and privacy practices apply to you, not ours. It is worth reading them.

9. No guarantee of results

Physical therapy outcomes vary from person to person, and depend on the condition, how long it has been there, other health problems, and how much of the plan somebody is able to do. Nothing on this site is a promise or guarantee that you will get a particular result, or any result at all.

Patient stories on this site describe one person’s experience and are published with their written consent. They are not typical, not predictive, and not a commitment to you.

10. The site is provided as it is

We work to keep this site accurate, current and available, but we cannot promise it is free of errors, that it will never be interrupted, or that every page reflects the latest clinical evidence on the day you read it. To the fullest extent the law allows, the site is provided “as is” and “as available” and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, RedCore and its owners, employees and contractors are not liable for any indirect, incidental, special or consequential loss arising out of your use of this website or your reliance on anything published on it.

Nothing in these terms limits any liability that cannot lawfully be limited. In particular, this clause does not limit our responsibility for the clinical care we actually provide to our patients, which is governed by professional standards and by law, not by a website notice.

TO CONFIRM — counsel to set the cap, the carve-outs, and the exact wording, and to confirm the limits are enforceable under both New York and New Jersey law. This is the clause a court is most likely to strike if it is drafted from a template.

12. Accessibility

We want this site to be usable by everyone, including people using a screen reader, keyboard navigation or magnification.

If something here is difficult or impossible for you to use, please tell us. Email info@redcorept.com or call (718) 509-9888. We will fix it, and in the meantime we will give you the information you were after another way.

TO CONFIRM — whether to name a conformance standard here at all. The draft deliberately claims none: no accessibility audit has been run against this site, and an unverified "meets WCAG Level AA" statement on a healthcare site increases ADA exposure rather than reducing it. Name a standard only once an audit supports it, and let counsel decide between a conformance claim and a commitment.

13. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules.

TO CONFIRM — the venue clause (which courts, in which county), and how counsel wants to handle the fact that we also operate a clinic in New Jersey. A New Jersey patient may be able to rely on New Jersey law whatever this clause says, so it should be drafted deliberately rather than left as a default.

14. Changes to these terms

We may update these terms as the practice, the site or the law changes. The current version will always be published on this page and will carry the date it took effect. Continuing to use the site after a change means you accept the updated terms.
